Your Trusted Partner For Detailed Legal Solutions With Client-Centered Compassion

Experienced Michigan Construction Law Attorney

Business is booming in Michigan.  In the bustling world of construction, the foundation of a successful project is not just steel and concrete – it is meticulous documentation, clear communication, compliance with state and federal regulations, and diligent management of contract provisions.  These elements are the lifeblood of successful projects.  Yet, despite their importance, many projects falter, and the parties involved are unable to resolve disputes without legal help.

Just what is construction law?  What is construction defect law and how does it help or hurt companies?  What is constructive notice in property law?  Tina S. Gray has been answering these and other client questions for more than two decades.

Legal Support for Builders and Subcontractors Statewide

The legal team at Tina S. Gray, P.C., routinely represents and advises builders, subcontractors and suppliers in the construction industry throughout the state in matters concerning construction law, including Michigan’s:

  • Construction Lien Act – This act provides contractors, subcontractors, and suppliers with a mechanism to secure payment for their services and materials.  Under this act, these parties can place a lien on the property they have worked on if they are unpaid.  This lien serves as a claim against the property, securing the amount due and potentially leading to a foreclosure sale if the debt is still unpaid.
  • Builders Trust Fund Act – To protect payments made to contractors and subcontractors, the act establishes a trust fund to benefit laborers, suppliers, and subcontractors.  Under this act, funds paid to a contractor for a construction project are considered trust funds and must be used to pay for labor and materials before other purposes.  Misappropriation of these funds can lead to severe penalties, including criminal charges.
  • Collection issues – Such matters arise when contractors, subcontractors, or suppliers do not receive payment for their work or materials.  Collection can be complex, involving multiple parties and extensive documentation.  Legal avenues for payment collection may include filing a claim under the Construction Lien Act or pursuing a breach of contract action.
  • Contract compliance – This refers to adherence to the terms and conditions in the construction contracts.  This includes meeting deadlines, quality standards, and payment schedules.  Non-compliance can lead to legal disputes, financial penalties, or contract termination.
  • Performance disputes – The quality of work, adherence to project timelines, or the interpretation of contract terms can lead to performance disputes.

In addition, the legal team at Tina S. Gray, P.C. has also helped construction clients draft contracts, incorporate their businesses or form limited liability companies, and understand the compliance issues that govern each entity type.
